Brown was clearly kicked at the ball, something which is very much legal in a ruck, I don't know about yourself but I'm pretty sure rugby players don't have eyes in the back of there head so Brown could have had no idea where Murray's head was, the reason why he continued to kick on regardless after the unfortunate accidental kick or Murray is that the ball was at England's try line and England's defence was only just getting set up again, he needed to get rid of the ball to provide his team the breathing space they needed, no intention to harm Murray whatsoever so therefore penalty, nothing less.
